Terms of Service

Last updated: October 24, 2026

These terms govern your use of Mighty Tour: the website at mightytour.app, the application at api.mightytour.app, hosted artist pages, the public API and the Mighty Tour WordPress plugin (together, the “Service”). The Service is operated by Marc Gratch Consulting, Fort Worth, Texas, USA (“Mighty Tour”, “we”, “us”). By creating an account or using the Service you agree to these terms. If you use the Service for a company, band or other organisation, you confirm that you can accept these terms on its behalf.

1. The Service

Mighty Tour helps touring teams manage tours, show dates, venues, crew, travel, advancing, documents and money, and publish tour dates to hosted artist pages, calendar feeds, WordPress sites and a public API. We improve the Service over time and may change features. We will not remove a core feature from a paid plan without telling you first.

2. Accounts and teams

You must give accurate information and keep your sign-in details secure; we recommend turning on two-factor authentication. You are responsible for activity under your account and for the people you invite to your team. Team owners and admins decide who can see what, so assign roles with care. Tell us straight away if you think someone has accessed your account without permission.

3. Plans, billing and cancellation

The Free plan costs nothing. The Artist and Agency plans are billed monthly or yearly in advance through Stripe, at the prices shown on our pricing page when you subscribe. The Agency plan includes ten artists and charges per month or per year for each additional artist. Enterprise plans are agreed in a separate contract. Prices do not include taxes, which may be added where they apply.

When you change plans, Stripe adjusts your charges for the rest of the current period. You can cancel at any time from the billing page; your plan stays active until the end of the period you have paid for and then ends. We do not refund partial periods, except where the law requires it. If a payment fails and is not resolved after notice, we may move your team to the Free plan.

4. Acceptable use

You agree not to:

  • use the Service to send spam or email people who have no relationship with your team;
  • store or publish content you do not have the right to use, or that is unlawful;
  • try to access other teams’ data, test or bypass our security, overload the Service, scrape it, or reverse-engineer it;
  • enter sensitive personal information about other people (such as passport details or medical notes) without a lawful basis for doing so. Your team is responsible for having that basis, for example the person’s consent.

We may suspend an account that breaks these rules. Where it is practical, we will tell you first and give you a chance to fix the problem.

5. Your content

You own the content your team puts into the Service. You give us permission to host, process, back up and display it only as needed to provide the Service, including publishing the tour dates and profiles you mark as public. We handle personal information as described in our Privacy Policy. Account owners can export their team’s data from the application at any time.

6. Third-party services

You can connect the Service to third parties such as Stripe, Google Calendar, Microsoft 365, DocuSign, Mapbox, Shopify, Square, WooCommerce and WordPress. Their own terms apply when you use them, and we are not responsible for their availability or for what they do.

7. Availability and support

We work to keep the Service available but cannot promise it will never be interrupted. We will announce planned maintenance in advance where we can. For help, write to us through our contact page; we aim to reply within one business day (US Central time).

8. Disclaimers and limitation of liability

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect or consequential losses, such as lost bookings, revenue or data. Our total liability for all claims relating to the Service is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

9. Ending your account

You can stop using the Service at any time. Account owners can delete the team account from Settings. Deleting it cancels any paid plan at once (without a refund for the current period), and the account and its data stop being accessible immediately, so export anything you need first. The data is permanently erased 30 days later. We may suspend or end your access if you seriously or repeatedly break these terms, if a payment remains unpaid after notice, or if the law requires it. Unless the reason is a serious breach or a legal requirement, we will give you notice and 30 days to export your data. Deleted data is handled as described in the Privacy Policy.

10. Changes to these terms

We may update these terms. We will post the new version here and update the date at the top. For significant changes, we will tell account owners in the application or by email at least 14 days before the changes take effect. If you keep using the Service after that date, you accept the updated terms.

11. Governing law

These terms are governed by the laws of the State of Texas, USA. Any dispute will be heard in the state or federal courts in Tarrant County, Texas, unless the law where you live gives you the right to bring it elsewhere.
